To ensure that the buying process runs smoothly, we check the Contract of Sale and then perform all appropriate statutory searches.

The following are some of the actions we take to make the conveyancing process for the buyer run smoothly:

  • There are many different steps in the buying process, that need our intervention and one of the first steps is to make sure that the seller legally has the right to sell the property and to double check that you are buying the property you think you are buying.
  • We perform title searches and check for any covenants or restrictions on the property.
  • Arrange for the payment of any government fees, such as stamp duty or may assist you in the facilitation of any stamp duty exemption or concession or government bonus subject to your eligibility and should you instruct us to do so.
  • If so instructed, we make sure the building and pest inspections or survey report or building certificate of compliance or the strata inspection report( in the case of a strata unit)  have been performed and are satisfactory prior to exchange of contracts.
  • Check that there are no outstanding debts with the council or utility companies.
  • Arrange for the exchange of contracts if this has not occurred.
  • If instructed to do so, lodge a purchaser’s caveat to protect your interest after exchange and before completion
  • We liaise with your mortgagor or financer, arrange the settlement date and attend the settlement for the final transfer of the property.
  • We make sure that your mortgagor or financer has all the appropriate documents for settlement.
  • We ensure that all documents are in registrable form to transfer a good title to you.

There are numerous checks and balances that a professional conveyancer needs to perform to ensure that the selling process and transfer of title runs smoothly:

  • We prepare the Contract of Sale and attend to all matters that need to be addressed prior to exchange of contracts.
  • Make sure that the deposit has been paid.
  • We liaise with your mortgagor or financer to request the final payout balance and preparation of mortgage discharge documents.
  • Ensure that all conditions of the contract are fulfilled by the due dates.
  • Liaise with the buyers’ conveyancer/solicitor to progress the transaction at the different stages.
  • Ensure that the proper adjustments are made for council and water rates and land tax (if applicable) and strata levies (if appropriate)
  • Confirm the real estate agent’s commission with you.
  •  Calculate the dispersal of monies to the appropriate parties for settlement.
  • Arrange and attend settlement with the buyer’s representative and your discharging mortgagee.
  • Ensure title has been transferred following settlement and that any outstanding rates or other taxes have been paid.
